The pur­pose of this Fre­quent­ly Asked Ques­tions (FAQ) doc­u­ment is to clar­i­fy cer­tain aspects of Direc­tive 2012/19/EU (here­after referred to as the “Direc­tive”), which entered into force on 13 August 2012 and which Mem­ber States were required to trans­pose into nation­al law by 14 Feb­ru­ary 2014. At that time, Direc­tive 2002/96/EC (the “old WEEE Direc­tive”) was repealed. The doc­u­ment is prin­ci­pal­ly intend­ed to help com­pe­tent pub­lic author­i­ties and eco­nom­ic oper­a­tors inter­pret the pro­vi­sions of the Direc­tive in order to ensure com­pli­ance with the Directive’s require­ments. How­ev­er, the Direc­tive being addressed only to the Mem­ber States, the rights and oblig­a­tions for pri­vate par­ties exclu­sive­ly flow from the mea­sures enact­ed by the author­i­ties of the Mem­ber States to imple­ment it.
